Privacy Policy

This Privacy Policy explains how SolutionsByClearPath ("ClearPath," "we," "us," or "our") collects, uses, discloses, and protects information we obtain through our website, our voice calling services, and our SMS/text messaging communications. It applies to visitors, prospective clients, clients, and any individual who calls, texts, or is called or texted by us or on our behalf.

1. Scope

SolutionsByClearPath provides custom software, cloud, data, and communications-enabled products and services to business clients, including services that involve outbound and inbound voice calls and SMS/MMS text messaging on behalf of ClearPath or our clients. This Privacy Policy applies to:

  • Visitors to solutionsbyclearpath.com and any subdomains;
  • Individuals who submit information through our Contact form, email, or phone;
  • Individuals who receive or place calls, or send or receive SMS/MMS messages, to or from ClearPath or a phone number associated with our services;
  • Clients, prospective clients, and authorized users of ClearPath products.

This Policy does not apply to third-party websites, applications, or services that we do not own or control, even if linked from our site.

2. Information we collect

We collect information in three ways: information you provide directly, information collected automatically, and information collected through voice and SMS communications.

2.1 Information you provide directly

  • Contact and identity data: name, company name, job title, email address, mailing address.
  • Phone number and messaging data: the mobile or landline number you provide when submitting a form, requesting a callback, or opting in to SMS updates.
  • Message content: the content of messages you send us via our Contact form, email, or SMS, including any details you choose to share about your project or business needs.
  • Payment and billing information: for clients under a signed services agreement, billing contact and invoicing details (we do not store full payment card numbers; payment processing is handled by a PCI-compliant third-party processor).

2.2 Information collected automatically

  • Device and usage data: IP address, browser type, device identifiers, operating system, referring URL, pages viewed, and timestamps.
  • Cookies and similar technologies: as described in Section 11.

2.3 Information collected through calls and text messages

  • Call metadata: the calling and called phone numbers, call date, time, and duration.
  • Call recordings: where legally permitted and disclosed at the start of the call, we or our clients may record calls for quality assurance and training purposes.
  • SMS/MMS metadata and content: the sending and receiving phone numbers, message timestamps, delivery status, and the text/media content of messages exchanged with us.
  • Opt-in and opt-out status: a record of your consent to receive messages or calls, and any opt-out (e.g., "STOP") requests, which we retain to honor your preference and demonstrate compliance.

3. SMS & voice communications

ClearPath and its clients use SMS/MMS text messaging and outbound/inbound voice calling as part of providing and marketing services. This section describes our specific commitments around those channels.

3.1 Consent

We only send recurring SMS/MMS marketing or informational messages, or place outbound marketing calls, to phone numbers that have provided prior express consent through one of the following methods: submitting our website Contact form and checking the applicable consent box, verbally providing consent during a call that is documented in our records, or signing a services agreement that includes a communications-consent clause. Consent to receive SMS messages or calls is never a condition of purchasing any goods or services.

3.2 Message frequency and cost

Standard disclosure Message frequency varies based on your interactions with us. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. For help, reply HELP to any message or contact us using the details in Section 15. To stop receiving messages at any time, reply STOP. You may receive one final message confirming your opt-out.

3.3 Supported carriers

Our SMS/MMS program is intended to work with major U.S. wireless carriers. Coverage, deliverability, and features are not guaranteed on every carrier or device, and carriers may impose their own restrictions on message content or delivery.

3.4 Call recording disclosure

Where we or a client record calls, we provide a verbal or automated disclosure at the start of the call. By remaining on the line after that disclosure, you consent to the recording, in accordance with applicable state and federal two-party or one-party consent laws.

3.5 Do-Not-Call and internal suppression list

We maintain an internal do-not-call/do-not-text suppression list. Any number that opts out via "STOP," verbally requests not to be contacted, or is registered on the National Do Not Call Registry (where applicable to the campaign type) is added to this list and excluded from future marketing outreach, subject to applicable legal exceptions (e.g., transactional or account-servicing communications).

4. How we use information

We use the information described above to:

  • Provide, operate, and maintain our services and respond to inquiries submitted through our Contact form;
  • Send requested SMS/MMS updates, appointment reminders, and account- or project-related notifications;
  • Place outbound calls or send outbound marketing messages to individuals who have opted in;
  • Process and fulfill service agreements, including billing and account administration;
  • Improve and secure our website and services, including diagnosing technical issues;
  • Comply with legal obligations, enforce our Terms & Conditions, and protect against fraud or misuse;
  • Maintain records of consent and opt-out status to comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier/aggregator requirements.

5. Legal basis for processing

Where applicable law requires a legal basis for processing (for example, under the GDPR for individuals in the EU/UK), we rely on one or more of the following: your consent (for SMS/voice marketing and non-essential cookies); performance of a contract (for clients under a services agreement); our legitimate interests in operating and improving our business, provided those interests are not overridden by your rights; and compliance with a legal obligation.

6. How we share information

We disclose information only in the following circumstances:

  • Service providers: vendors who perform services on our behalf, such as SMS/voice platform providers (e.g., messaging aggregators and carriers required to deliver your message or call), cloud hosting providers, email delivery providers, payment processors, and analytics providers — each bound by contractual confidentiality and data-use restrictions.
  • Legal and safety reasons: to comply with a subpoena, court order, or other legal process; to enforce our Terms & Conditions; or to protect the rights, property, or safety of ClearPath, our clients, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections and, where required, notice to affected individuals.
  • With your direction: when you explicitly ask us to share information with a named third party.

7. No sale or sharing of SMS/voice opt-in data

Carrier & compliance disclosure Text messaging originator opt-in data and consent — including mobile phone numbers collected for SMS/MMS purposes — will not be sold, rented, licensed, or otherwise shared with any third party or affiliate for their own marketing or promotional purposes. This information is used exclusively to provide the SMS/voice program you opted into, and is shared only with the service providers described in Section 6 as strictly necessary to deliver that program (for example, our SMS aggregator and underlying carrier network).

This commitment applies regardless of any more general data-sharing language elsewhere in this Policy — where there is any conflict between this section and another section regarding SMS/voice opt-in data specifically, this section governs.

We may retain information longer where required by law, to resolve disputes, or to enforce our agreements.

9. Data security

We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, alteration, disclosure, or destruction, including encryption of data in transit (TLS), access controls limiting internal access on a need-to-know basis, and regular review of our systems and vendor security practices. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Your rights & choices

10.1 SMS/voice opt-out

Reply STOP to any text message to opt out of future SMS/MMS messages, or verbally request removal during any call. You may also submit a request through our Contact page.

10.2 Access, correction, and deletion

Depending on your location, you may have the right to request access to, correction of, or deletion of your personal information, to object to or restrict certain processing, and to request a portable copy of your data. To exercise these rights, contact us using the details in Section 15. We will verify your request and respond within the timeframe required by applicable law.

10.3 California residents (CCPA/CPRA)

California residents have the right to know what personal information we collect, request deletion, correct inaccurate information, opt out of "sale" or "sharing" of personal information (we do not sell personal information as defined by the CCPA), and not be discriminated against for exercising these rights.

10.4 EU/UK/EEA residents (GDPR)

If you are located in the EU, UK, or EEA, you have rights including access, rectification, erasure, restriction, data portability, and the right to object to processing based on legitimate interests, as well as the right to lodge a complaint with your local supervisory authority.

11. Cookies & tracking technologies

We use cookies and similar technologies to operate our website, remember preferences, and understand site usage. Categories include:

  • Strictly necessary: required for core site functionality (e.g., security, load balancing).
  • Analytics: help us understand how visitors use our site so we can improve it.
  • Functional: remember choices you make to personalize your experience.

You can control cookies through your browser settings. Disabling certain cookies may affect site functionality.

12. Children's privacy

Our services are intended for businesses and individuals who are at least 18 years old. We do not knowingly collect personal information from children under 13 (or the applicable age of digital consent in your jurisdiction). If we learn we have inadvertently collected such information, we will delete it promptly. Parents or guardians who believe we may have collected information from a child should contact us using the details in Section 15.

13. International users

SolutionsByClearPath is based in the United States, and information we collect is generally processed and stored in the United States. If you access our services from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States or other countries, which may have different data protection laws than your jurisdiction.

14. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will post the updated policy on this page with a revised "Last updated" date, and where changes are material, we will provide additional notice (such as a website banner or, for SMS-related changes, a text message where appropriate).
